I look forward to the opportunity of helping you purchase your next home and/or sell your existing one. The experience of buying and selling a home can be an emotional one. The agent that you choose to work with and the professional relationship that you choose to have with your agent can play a significant role in determining what your personal buying or selling experience will be.

 It’s not only essential that you are given the opportunity to choose the agency relationship that you have with your agent, but it’s also the law in Mississippi. The Mississippi Real Estate Commission requires agents to disclose all legal agency relationship options to potential clients/customers at the first substantive meeting. No real estate matters should be discussed between an agent and a potential client/customer prior to this disclosure. Failure to adhere to this rule could damage your negotiating position later on.

 It’s also extremely important to inform me immediately if you have been working with another agent anywhere in Mississippi. Please let me know as soon as possible if you have spoken with another agent, regardless of whether you entered into a buyer representation agreement or listed your home or property with the agent.

 RE/MAX Choice Properties practices three types of agency. We will work with you as our customer, our client, or as a disclosed dual agent. The services and duties that you are required to receive by law vary widely from one agency type to the others. Also, the agency type that you choose will determine which property or properties I'm allowed to show you and help you to purchase or if I can list your home or property for sale.

 The three agency types and their definitions;

 CUSTOMER- A party not represented in a real estate transaction. The agent may only show properties to the customer where the agent represents the seller. A buyer’s representation agreement is not executed for an agent-customer relationship. However, the “Working With A Real Estate Broker” form which discloses the agency relationship must be signed by both the agent and the customer prior to any discussion or the actual showing of real estate. The customer receives a reduced level of duties as listed under the fiduciary duties as compared to a client. Do not tell the agent anything that you don’t want the seller to know!

 CLIENT- A party contractually represented in a real estate transaction. The agent may only show properties to the client where the agent represents the buyer only. A buyer representation agreement must be executed for the agent-client relationship to be authorized. A represented client receives all the fiduciary duties of an agent/client relationship. A seller must be a client of RE/MAX Choice Properties in order for us to offer your home or property for sale.

 DISCLOSED DUAL AGENT- A relationship where the agent is contractually authorized by two parties (buyer and seller) to represent the interest of each in a real estate transaction. The agent may show properties to the client where the agent represents the buyer only or the buyer and the seller. Both buyer and seller receive fiduciary duties. However, both clients must agree to a reduced level of service and waive the fiduciary duties of confidentiality, undivided loyalty and full disclosure. A buyer representation agreement and a Disclosed Dual Agency Disclosure form must be executed for a dual agency relationship to be authorized.

| Code of Ethics |
The Code establishes time-honored and baseline principles that come from the collective experiences of REALTORS® since the Code of Ethics was first established in 1913. Those same principles later evolved into FIDUCIARY duties owed to clients. A fiduciary relationship involves a confidence of trust, usually established through a contractual agreement between two parties for the acquisition of real property.

 These duties are established once an agency relationship is created. An agency relationship is created by express (written) and/or implied (unwritten) agreement between an agent and a client. Implied agency should be avoided. The risks associated with implied agency far outweigh any benefit and could prove costly to the agent as well as the client.

 The fiduciary (legal) duties of an agency relationship are:

 Undivided Loyalty - Agent is prohibited from advancing any interest adverse to the client or to conduct the clients business to the detriment of the client’s interest

 Obedience – Agent is required to act, follow and abide by all lawful instructions, subject to the clients continuous control, but not exceeding the scope of authority. Simply, don’t make decisions for the client

 Skill, Care & Diligence – Agent is required to protect the client from foreseeable risks of harm, recommending the client obtain expert advice when clients needs are outside the scope of the agents expertise

 Confidentiality – Agent is prohibited from disclosing personal information about a client that was given or acquired within the scope of the agent’s duties

 Full Disclosure – Agent is required to disclose all information concerning a transaction and property which may affect the decisions a client makes

 Accounting – Agent is required to promptly report all money and property received and paid out upon request and to safeguard all money or property held on behalf of the client

 Mississippi statutes require that the disclosure of all legal forms of Agency relationships is made to a potential client at the first substantive meeting. Failure to make this disclosure and the opportunity for the potential client to make an informed decision regarding any agency relationship before any real estate matters are discussed is a violation of the statute and carries severe penalties for the offender.

 The Code also requires that strict guidelines are followed in relationship to advertising, working with cooperating real estate brokers, business practices and more.

To earn a designation, a REALTOR® has taken coursework and demonstrated specific skills, performance and knowledge in a particular area of the real estate industry

 The Graduate REALTOR® Institute (GRI) symbol is the mark of a real estate professional who has made the commitment to provide a high level of professional services by securing a strong educational foundation. REALTORS® with the GRI designation are highly trained in many areas of real estate to better serve and protect their clients.

 The Accredited Buyer Representative (ABR®) designation is the benchmark of excellence in buyer representation. This coveted designation is awarded to real estate practitioners by the Real Estate Buyer's Agent Council ("REBAC") of the National Association of REALTORS® who meet specified educational and practical experience criteria.

 The e-PRO. An e-PRO is a REALTOR® who has successfully completed the e-PRO training program for real estate professionals. Endorsed by the National Association of REALTORS®, the e-PRO course teaches professionals the nuts and bolts of working with real estate on-line: Web sites, e-mail, on-line tools, and most of all, what today's consumer really wants.
